These Terms of Service are entered into by and between you (“user”) and CATHOLICUS. The following Terms of Service, together with any documents they expressly incorporate by reference, govern your access to and use of www.catholicus.info including any content, functionality, and services offered on or through our Website, www.catholicus.info and/or our Website in Spanish, www.es.catholicus.info and other media outlets, including social media outlets, and any other online services. Please read the Terms of Service carefully before you start to use the Websites. By using our website, you accept and agree to be bound and abide by all the terms and conditions of this Terms of Service, including our Privacy Policy, each incorporated herein by reference. If you do not want to agree to these Terms of Service or the Privacy Policy, you must not access or use the Website.

These Terms of Service, together with our Privacy Policy and any subsequent privacy notices or click-through agreements, contain the entire understanding and agreement between you (“user”) and CATHOLICUS with respect to the Website and it supersedes all previous communications, negotiations, and agreements, whether oral, written, or electronic, related to any understanding or agreement. We may revise and update these Terms of Use from time to time in our sole discretion. All changes are effective immediately when we post them and apply to all access to and use of the Website thereafter. However, any changes to the dispute resolution provisions set out in Applicable Law and Jurisdiction will not apply to any disputes for which the parties have actual notice before the date the change is posted on the Website.

This Website is mainly aimed at Users residing in the United States, by which, it is not guaranteed that the Website complies totally or partially with the legislation in other countries, so that, if the User resides or has an address in another country and decides to access or use the Website under its own responsibility and must ensure that such access and navigation complies with the local legislation that is applicable to the User. Catholicus does not assume any responsibility that may be derived from such an act.

Parties

Throughout this Agreement “we”, “us”, “our” and “ourselves” along with “Catholicus” refers to CATHOLICUS its owners, directors, partners, and authorized representatives – unless otherwise noted. “You”, “your”, “yourself”, and “user” refers to anyone accessing the Website and includes the company, association,  or entity that the user represents.

Conditions of Use

When using our Website, it is recommended that users under the age of 13 are under adult supervision to discern published information.

Every time you use our Website you agree to:

  1. All the conditions contained in this Terms of Use and the Privacy Policy;

  2. Not to use the material found on our Website for any purpose not intended by us; and

  3. Only use the content on our Website in accordance with all laws that may apply.

 

Site Description

This Website is a resource platform for ministry and an educational community for people who want to serve persons with disAbilities in Adaptive Catechesis and Evangelization, grow in their spiritual life, gain skills to implement in their classroom and home, and be better formed. Within CATHOLICUS, Users will be able to register for online courses, access content, interact with people who have the same interests when reading or commenting on articles or tutorials.

Intended Purposes

By using our Website, you agree not to use it in order to discriminate on the basis of race, ethnicity, gender, age, creed, religion, disAbility or any other legally protected class. In addition, you agree not to use the information contained in our online material to misrepresent or harm CATHOLICUS or the Catholic Church.

To the extent that our Website offer comments, responses, or other similar user participation, please be aware that you cannot advertise, solicit, bargain, or exchange money, goods or services on our Website. Abuse, harassment, bullying, intimidation, threats, and other negative content will not be tolerated. We reserve the absolute right to remove anyone for behavior we deem is offensive or illegal.

We can’t monitor all participation and content related to our Website, and so there should be no expectation that these types of behaviors won’t happen from time to time. By using our Website you assume all risk, including any interactions with other users (online or offline). We strongly suggest you take every precaution you can to protect yourself and your information. Please do not include private information (e.g. phones numbers, addresses, last names, email addresses, instant messaging info, etc.) in any public areas of the Website. We also don’t necessarily endorse or agree with all content, business practices, advertising, services, or products from third parties. Once you leave our Website, you are subject to that location’s agreement(s) and we can’t be responsible for the management of your information.

The scope of the information and services provided by us are limited. We make no other promises outside of those explicitly stated here or within the Website.

The laws of California will govern these Terms of Use or any dispute or claims relating to the Terms of Use. All disputes and claims will be arbitrated or litigated in California, and you consent to the exclusive jurisdiction and venue of the State and Federal courts in California.

All User Content provided by the user is the user’s own opinion and will not violate property rights. User Content does not and will not carry viruses or any harmful or destructive software.

If you believe someone has infringed another’s copyright protections, please notify us immediately. We take allegations seriously and will investigate the matter and terminate (according to the US Digital Millennium Copyright Act) any account we deem to be a risk of further violations.

CATHOLICUS reserves the right to remove access and/or content of any user at our sole discretion. Please, do not use the Website for any negative end. We always want to ensure integrity and education.

Financial Agreement

When you sign up to use our services you should be aware that we use third-party vendors for the transactions. Along with your credit card service provider, we use a third party for processing payment. Please see our Privacy Policy for additional information regarding how your data is handled. CATHOLICUS reserves the right to change its fees or charges for the services offered on the Website, considering that the fees paid prior to such changes will not be affected.

Waiver and Severability

No waiver by us of any term or condition set out in these Terms of Use shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition, and any failure by us to assert a right or provision under these Terms of Use shall not constitute a waiver of such right or provision.

If any other provision of these Terms of Use is held to be invalid or unenforceable, the offending provision shall be eliminated or limited to the minimum extent so as to best accomplish the objectives of the original provision to the fullest extent allowed by law and the remaining provisions of these Terms of Use will remain in full force and effect.

Online Courses and Other Terms and Conditions

All courses through our Website formed through the Website, or resulting from visits made by you, are governed by our Privacy Policy, which are hereby incorporated into these Terms of Use.

Additional terms and conditions may also apply to specific portions, services, or features of the Website. All such additional terms and conditions are hereby incorporated by this reference into these Terms of Use. Catholicus reserves the right to remove the offer of any course, at any time and for any reason.

Official Certificate

The Official Digital Certificate will be sent via email to the one provided by the User registered in the course upon completion and 100% completion of the established activities. Official certificate is issued by the Rectory of Nuestra Señora de los Dolores Puebla, located at 10 Ote. No. 806, Col. Centro, Puebla, Puebla, Mexico. If you are going to receive the sacrament outside Puebla, Mexico, you must first consult with the parish in which the reception of the Sacrament will take place.

Return Policy

Once Students access and register for any of our courses, students accept the terms and conditions of the Lifelingua platform, responsible for the management of the different courses in the catalog. Within CATHOLICUS return policies, students will be entitled to a full refund of the paid value of a course only up to 60 days after payment of the same. To apply for the return of a paid course, conference or program, the Student must send an email to ministry@catholicus.info confirming their desire to leave the course and requesting a refund of the value of the same. Once the period of 60 days after registration has elapsed, if the Student has not requested his refund and wishes to leave a course, the Student will not be entitled to a refund of the value paid for the content purchased.

For Your Protection

Use of our Websites and materials may grant you specific legal rights that will vary by location. Some jurisdictions do not allow certain kinds of limitations or exclusions of liability and so some contained in this Agreement may not pertain to you. We reserve all available limitations and exclusions allowable under applicable law. Whatever statutory rights you may have as a consumer that conflict with the provisions above are not affected by these provisions, and we do not seek to exclude or limit liability for fraudulent misrepresentation.

Intellectual Property

The trademarks, logos, sample codes and other contents of CATHOLICUS included on the Website and the service offered are protected by intellectual property rights. Access to the Website does not grant you the rights to these materials. It is forbidden to use all content relating to CATHOLICUS unless written permission is requested and/or granted.

Entire Agreement

The Terms of Use and our Privacy Policy constitute the sole and entire agreement between you and CATHOLICUS regarding the Website and supersede all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral, regarding the Website.
